Terms and Conditions of Sale

These Terms and Conditions of Sale govern the sale of products by La Guirlande Française, operated by Elles Untold (Siret: 903 015 543 00015), via its website. Any order placed on the La Guirlande Française website implies full and complete acceptance of these TCS by the customer.

1. Products

La Guirlande Française offers handmade fabric bunting for sale. Each product is described as accurately as possible. However, minor variations (such as color or exact fabric pattern for customized orders) may occur due to the handmade nature of the products and differences in users' screen displays. Product photographs are not contractually binding.

2. Prices

All prices are displayed in Euros (€), including all applicable taxes (VAT), but excluding shipping costs. Shipping fees are added at checkout and are clearly indicated before final payment. La Guirlande Française reserves the right to change its prices at any time, but products will be billed based on the prices in effect at the time the order is confirmed.

3. Orders

To place an order, the customer must follow these steps:

• Select desired products and add them to the cart.

• Validate the shopping cart.

• Fill in delivery and billing information.

• For customizable products, indicate preferences (patterns, colors) in the dedicated section.

• Choose the delivery method.

• Review and confirm the order, accepting these TCS.

• Proceed with payment.

Order confirmation by La Guirlande Française, sent via email, constitutes final acceptance of the order.

4. Customization

For orders including customization of patterns or colors, the customer must indicate preferences in the designated text field at the time of ordering. La Guirlande Française will make every effort to meet these requests, sourcing the necessary fabrics. Due to the handmade nature of the products and fabric availability, minor adjustments may be necessary, while respecting the customer’s original request.

5. Payment

Payments are made online via secure payment methods offered on the website (e.g. credit card via Stripe, PayPal, etc.). Orders will only be processed after confirmation of payment by the banking institution.

6. Delivery

Products are delivered to the address provided by the customer when placing the order. Delivery times are provided for information purposes and may vary depending on the type of product (in-stock or customized) and the destination. La Guirlande Française commits to shipping orders as promptly as possible after payment is received.

The customer assumes responsibility for any risks related to transport once the products have left the premises of La Guirlande Française. In case of damage during transport, any claim must be made directly to the carrier within three (3) days of delivery.

7. Right of Withdrawal and Returns

In accordance with Article L.221-18 of the French Consumer Code, the customer has fourteen (14) days from receipt of the product to exercise their right of withdrawal, without providing any reason or incurring penalties, except for return shipping costs.

However, this right of withdrawal does not apply to products made to the consumer's specifications or clearly customized (Article L.221-28 of the French Consumer Code). Therefore, customized buntings with specific patterns or colors chosen by the customer are excluded from the right of withdrawal.

For non-customized products, items must be returned in new and complete condition (including packaging, accessories, instructions, etc.) suitable for resale, along with the purchase invoice. Return shipping costs are borne by the customer. Refunds will be processed within fourteen (14) days after receipt of the returned products.

8. Warranties

All products benefit from the legal guarantee of conformity (Articles L.217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

In the event of non-conformity of a product sold, it may be returned, exchanged, or refunded. All claims, requests for exchange or refund must be made by email to laguirlandefrancaise@gmail.com within 30 days of delivery.

9. Liability

Elles Untold cannot be held liable for any damages resulting from the use of the Internet, such as loss of data, intrusion, viruses, service disruption, or any other involuntary issues.

10. Governing Law and Disputes

These TCS are governed by French law. In case of dispute, the parties will endeavor to reach an amicable solution. Failing that, only French courts shall have jurisdiction.
